U.S. President-elect Donald Trump won a major legal breakthrough Monday. This, when U.S. District of Columbia District Judge Tanya Chutkan ruled to close the 2021 election meddling and Capitol assault case. The decision comes in response to a request from special prosecutor Jack Smith, who argued that Justice Department regulations preclude prosecuting a sitting president.
Two federal cases filed
Jack Smith also dropped the prosecution over classified documents Trump allegedly withheld from his Mar-a-Lago residence. These cases, culminated in the Supreme Court. That ruled that granted the former presidents broad immunity from prosecution. And make it difficult for the prosecutions to move forward.
Trump promised during his campaign to fire Smith and close the investigations, which he called a “political persecution”. With this resolution, the former president adds a judicial victory that contrasts with the multiple criminal charges he faced in recent years.
Context of the accusations against Trump
In Washington, Trump was accused of attempting to reverse the results of the 2020 elections and of inciting his supporters to storm the Capitol. However, these are not Trump‘s only legal fronts. He still faces election interference charges in Georgia. The prosecutor in charge of the case, Fani Willis, faced questions over personal issues that have impacted the investigation.
Trump, who is seeked to return to the presidency in 2024, already made history by becoming the first former president to be criminally convicted in a state case in New York. He was convicted of falsifying business records related to payments to former porn actress Stormy Daniels during the 2016 campaign. Although sentencing in that case was scheduled for November, Judge Juan Merchan postponed its issuance without announcing a new date.
